Giveaway rules

1. Organiser

The giveaways (“Giveaway”) are organised by Jakub Gabrychowicz, sole trader operating as JAKUB GABRYCHOWICZ GameGoods, ul. Łęczycka 15/1, 99-340 Krośniewice, Poland, NIP: 7752647541, REGON: 360765637 (“Organiser”), owner of yourpet.pl.

The Giveaways run on the YourPet profiles on Facebook and Instagram. Meta Platforms and Empik are not organisers or sponsors of the Giveaways and bear no responsibility for them. By taking part, each Participant releases Meta Platforms from any liability related to the Giveaway.

2. Duration and schedule

• Each Giveaway starts on Sunday at 6 pm (Polish time) when the giveaway post is published on the YourPet profiles, and lasts until the following Saturday at 11:59 pm.
• The schedule, tasks and prizes of all Giveaways are listed on the Giveaways page and in the giveaway post. The Facebook post and the Instagram post form one Giveaway with a shared prize pool, and entries from both are drawn together.
• Results are announced on the Monday after the Giveaway ends.
• The Organiser may move a Giveaway that has not started yet and will announce it on the Giveaways page. A Giveaway in progress is never shortened and its conditions are never changed to the Participants’ disadvantage.

3. Who can take part

• A Participant is a natural person aged 18 or over with full legal capacity, living in Poland, with a Facebook or Instagram account (“Participant”).
• A parent or legal guardian may enter their child’s answer in a comment. The parent or guardian is then the Participant and the potential winner.
• The Organiser, people working with the Organiser on the Giveaways and their immediate family members may not take part.
• Fake accounts or accounts created only to enter giveaways are excluded from the draw.

4. How to enter

• While the Giveaway is running: follow the YourPet profile on Facebook or Instagram, like the giveaway post and write a comment under it answering the task from the post.
• On Instagram, each additional comment in which you tag another person is an extra entry - up to 3 extra entries per Participant in one Giveaway. On Facebook, tagging friends or sharing is not a condition of entry and gives no extra entries.
• Taking part is free and requires no purchase of any kind, including Paws in YourPet.
• Only comments added while the Giveaway is running count. Comments edited after it ends and content that is unlawful, offensive, advertises other businesses or shows children’s faces are excluded from the draw and may be removed.
• Taking part in a Giveaway means accepting these terms.

5. Prizes

• The prizes of each Giveaway are listed in the giveaway post and on the Giveaways page. They are Empik gift cards and pets in the YourPet service.
• Empik gift cards worth 20 zł are given as plastic cards, and cards worth 50 and 100 zł as e-gift cards. Cards are redeemed on Empik’s terms and within the validity period set by Empik.
• A “pet made from your photo” or “pet made from your description” prize is 20 Paws, and a “revived pet” is 35 Paws, credited to the winner’s YourPet account - the price of creating such a pet. Claiming it requires a YourPet account, which is created by an adult.
• Prizes cannot be exchanged for cash or for another prize. Paws from a prize are non-refundable.
• One Participant can win one prize in one Giveaway.

6. Draw and results

• The Organiser draws the winners on the Monday after the Giveaway ends, from the entries that meet the conditions of section 4, using a random comment picker. The draw is recorded.
• Before announcing, we check that the drawn person meets the conditions. If not, we draw again.
• Results are announced in a story, in a comment under the giveaway post and on the Giveaways page, with the winner’s profile name.

7. Claiming prizes

• After the draw we send the winner a private message from the YourPet profile. We never ask for passwords, payment card details or any fees - a message asking for them does not come from us.
• The winner replies within 72 hours with an email address (Empik e-gift card, Paws in YourPet) or a name and a postal address in Poland (plastic card). Without a reply within that time the prize is forfeited and the Organiser may draw another person.
• Prizes are delivered within 14 days of receiving the details. Plastic cards are sent by registered mail at the Organiser’s expense.
• The Organiser is not responsible for a prize that cannot be delivered because the winner provided incorrect details.

8. Participants’ comments and photos

• The Participant confirms that the comment, photo or drawing is their own or that they have the right to publish it.
• The Participant agrees that the Organiser may show their comment with their profile name in the results announcement and in a summary of the Giveaway on the YourPet profiles.
• Creating the winner’s pet and showing it on our profiles requires the winner’s separate consent.
• Please share photos of animals - without children’s faces and without details that could identify anyone.

9. Personal data

• The controller of the Participants’ personal data is the Organiser, contact: kontakt@yourpet.pl.
• We process the profile name and the comment, and for winners also the email address, name and postal address - only to run the Giveaway, announce the results, deliver the prizes and handle complaints (Art. 6(1)(b) and (f) GDPR).
• Winners’ data is kept until the prize is delivered and any complaint is resolved, and longer only where the law requires it (e.g. tax and accounting rules).
• You have the right to access, rectify and erase your data, to restrict processing, to object and to lodge a complaint with the President of the Polish Personal Data Protection Office (UODO). Details: Privacy policy.
• Meta Platforms processes data in its services on its own terms, as a separate controller.

10. Complaints

• Complaints about a Giveaway can be sent to kontakt@yourpet.pl within 14 days of the results announcement.
• We reply within 14 days of receiving the complaint, to the address it came from.

11. Final provisions

• These terms are available on the Giveaway terms page and via the link in the YourPet profile description.
• Changes to these terms do not apply to Giveaways already in progress and never worsen their Participants’ conditions.
• Matters not covered by these terms are governed by Polish law, in particular the Civil Code. The Polish version of these terms prevails.
